SteadyServe.Net Terms of Service |
- You agree that you are responsible for all the uses
of SteadyServe.Net’s services through your account,
with or without your knowledge or consent.
- You agree that you are at least 18 years of age and
able to enter into a legal contract.
- You agree that use of SteadyServe.Net’s services
is at your sole risk.
- You agree that any code or programming supplied by SteadyServe.Net
is solely owned by SteadyServe.Net and is supplied for
your use only while your maintain an active account with
SteadyServe.Net.
- You agree that you will not make copies of any of the
code or programming supplied by SteadyServe.Net.
You will not distribute SteadyServe.Net's code or programming
to any third party.
- You agree to not use SteadyServe.Net’s services
for any illegal activity under all federal, provincial,
state and local laws or link to or use your account to
help any other services that are engaged in illegal activity
under all federal, provincial, state and local laws. This
includes copyright violations.
- You agree not to use the SteadyServe.Net Service in
a manner that would infringe, violate or dilute any Copyright,
Trademark, Service Mark, or similar rights of any third
party. SteadyServe.Net reserves the right to remove any
and all materials which violate copyright laws. Such materials
will be removed at any time upon receiving a complaint
and or notice of copyright violation.
- You agree not to post information of another person’s
personal nature without that person’s written consent.
- You agree not to use SteadyServe.Net’s services
to post or traffic material that is offensive or harmful
to others, both of a personal or business nature.
- You agree that SteadyServe.Net may determine what may
be considered offensive or harmful to others.
- You agree not to use SteadyServe.Net’s services
or any of SteadyServe.Net’s vendor services for sending
unsolicited emails to those that you do not have a prior
relationship.
- You agree not to use SteadyServe.Net’s services
or any of SteadyServe.Net’s vendor services for sending
forged emails or emails with invalid return addresses.
- You agree that any email that you send through SteadyServe.Net’s
services or SteadyServe.Net’s vendor services will
have accurate information that will allow the recipient
of that email to be able to identify you and contact of
you.
- SteadyServe.Net may disclose the personal information
of accounts responsible for forged email messages to system
administrators or users requesting the information.
- You agree not to send email to ANY user who does not
wish to receive it. You agree to refrain from sending
further email to a user after receiving a request to stop.
- You agree not to run programs that will send more than
500 emails a day through SteadyServe.Net’s servers
with out SteadyServe.Net’s prior written consent.
- You agree not to use SteadyServe.Net’s Services
to compromise the security of system resources or accounts
on servers at SteadyServe.Net or at any other site.
- You agree that if you are involved in violations of
system security, SteadyServe.Net reserves the right to
release personal information of users involved in such
violations to system administrators at other sites in
order to assist them in resolving security incidents.
SteadyServe.Net will also fully cooperate with law enforcement
authorities in investigating suspected lawbreakers.
- System abuse includes any use of SteadyServe.Net resources
that disrupts the normal use of its servers or services
for others. Examples of system abuse include running excessive
numbers of processes or consuming excessive amounts of
CPU time, memory or disk space.
- You agree that SteadyServe.Net may charge additional
charges for using more system resources than expressed
in your account plan. You agree that you will be responsible
for these charges
- You agree that SteadyServe.Net may suspend your account
without notice if your account is consuming too many system
resources
- You agree not to use scripts or other utilities to direct
pointed domain names to subdirectories.
- You agree not to store any content on SteadyServe.Net’s
servers that can cause damage to, scan, or cause denial
of service to SteadyServe.Net’s servers or that can
distribute material to other computers, scan other computers
or cause denial of service to other computers without
the other computer owner’s knowledge regardless of
whether or not any actual intrusion results in the corruption
or loss of data.
- You agree that SteadyServe.Net shall not be responsible
for any claimed damages, including incidental and consequential
damages, which may arise from SteadyServe.Net servers
going off-line or being unavailable for any reason whatsoever.
- You agree that SteadyServe.Net limits its damages for
any non-accessibility time or other downtime to a single
monthly payment. SteadyServe.Net expressly limits its
responsibility for any damages arising as a consequence
of such unavailability.
- You agree that SteadyServe.Net does not refund payments
unless under SteadyServe.Net’s sole discretion on
a case by case basis.
- You agree that SteadyServe.Net shall not be responsible
for any claimed damages, including incidental or consequential
damages, resulting from the corruption or deletion of
any web site from one of SteadyServe.Net Virtual servers.
All damages shall be limited to the immediate termination
of service. While SteadyServe.Net does regularly back
up the servers it is not responsible for backing up your
personal data. You agree you will be responsible to take
the appropriate steps to ensure a backup copy of your
data.
- You agree that if you need SteadyServe.Net restore your
personal data from SteadyServe.Net’s back ups that
an extra charge will apply and that you may not receive
the latest copy of your files or a complete set of your
files from these backups.
- You agree that you are responsible for protecting your
password and for any authorized or un-authorized use of
your password.
- You agree that SteadyServe.Net has the right to change
or alter your password with notification to you if it
appears the security of your password has been compromised.
- You agree that SteadyServe.Net, its agents, affiliates,
licensors or the like, do not represent or warrant, expressly
or impliedly, that our services will not be interrupted
or error free; neither do they make any warranty as to
the results that may be obtained from the use of SteadyServe.net’s
services.
- You agree that you do not own any IP addresses that
may be assigned to you by SteadyServe.Net and SteadyServe.Net
reserves, in its sole discretion, the right to change
or remove any and all such IP addresses.
- You agree that use of any information obtained by way
of SteadyServe.Net is to be used at your own risk, and
SteadyServe.Net specifically denies any responsibility
for the accuracy or quality of information obtained through
its services.
- You agree that SteadyServe.Net may charge your credit
card if that is your choice of payment on a monthly or
quarterly basis. You are responsible for knowing your
renewal date and canceling your account before the renewal
date if you wish to cancel. Once a payment is received
you agree that SteadyServe.Net reserves the right to refund
that payment only under SteadyServe.Net’s sole discretion.
- All complaints of abuse, violation and misuse of the
Services, whether described in these terms of service
or otherwise, shall be investigated promptly. SteadyServe.Net
reserves the right to suspend your account while conducting
its investigation.
- You agree to hold SteadyServe.Net harmless from any
claims related to SteadyServe.Net investigating and enforcing
these terms of service. This includes the suspension of
your account during investigation if SteadyServe.Net suspects
the violation of these terms of service.
- You agree that SteadyServe.Net may modify the terms
and conditions of this Agreement or the prices of its
services, as well as discontinue or change the services
offered at any time without prior notice. You will be
bound by the modified Agreement, prices and/or policies
if you choose to use the services. Furthermore, SteadyServe.Net
retains the right to change any or all of the above Policies,
Terms of Service, Guidelines, and Disclaimer without notification.
- You agree that SteadyServe.Net, its officers, agents,
or anyone else involved in providing our services shall
not be liable for any direct, indirect, incidental, special,
or consequential damages that result from the use or inability
to use Company’s services; or for any damages that
result from mistakes, omissions, interruptions, deletion
of files, errors, defects, delays in operation, or transmission,
or any failure of performance, whether or not limited
to acts of God.
- You agree that in the event of a dispute, the venue
for litigation will be in San Francisco County, California
- You agree that in the event of default, the prevailing
party in the legal action is entitled to recover attorney
fees and court costs incurred in litigation of this matter.
- You agree that SteadyServe.Net may terminate your service
without notice and without any refunds of unused pre-paid
portion of funds for violation of these terms of service.
- You agree that SteadyServe.Net may terminate your service
without notice with refund of unused pre-paid portion
of funds for services not rendered.
- You agree that if any provision in this agreement is
held to be unenforceable, such unenforceability shall
not render the remaining provisions of this agreement
unenforceable.
